UPDATE (November 8, 2012) ATLANTA -- Denirio Cunningham was captured by the US Marshals Southeast Regional Fugitive Taskl Force on September 19, 2012.

Cunningham was staying with a girlfriend in Atlanta, according to Deputy US Marshal Eric Heinze. Heinze said they found Cunningham after receiving a tip through Crime Stoppers Atlanta.

A Clayton County grand jury indicted Cunningham, 20, and Joseph Harris, 23, on murder, burglary, aggravated assault, false imprisonment, criminal trespass and cruelty to children charges on November 7, 2012.

RIVERDALE, Ga. -- Denirio Cunningham is 11Alive's Fugitive of the Week for July 19.

Cunningham, 19, of Riverdale is wanted by Riverdale Police for murder.

Cunningham, also known as "D-Red", is charged with the murder of 25-year-old David Rucker of Riverdale. Joseph Harris, 23, of Riverdale is also charged with Rucker's murder. Harris is in custody in the Clayton County Jail, but Cunningham is still on the loose.

"Someone knows something about where Mr. Cunningham is and we're hopeful that we'll get a tip," Riverdale Police Chief Samuel Patterson said.

Rucker was shot and killed inside his apartment on Taylor Road on June 14. Rucker's wife and three children, ages 5, 4 and 1, were in the apartment when it happened.

Chief Patterson said Harris and Cunningham planned a burglary at Rucker's apartment but didn't think he or his family was home when they broke in.

Police said the two suspects climbed up on an air conditioning unit behind the second floor apartment and one boosted the other up onto a deck. One suspect went in through an open window and let the other suspect in the front door.

While the suspects were in the apartment, Rucker came out of a back bedroom and closed the door to protect his family.

"There was a struggle apparently to keep the suspects from going into the bedroom where (Rucker's) family was," Patterson said.

During the struggle, Cunningham shot Rucker once in the chest, according to Patterson.

"(Rucker's family) don't see what was going on, but I'm sure they could hear the scuffle and certainly they heard the gunshot," he said.

Police believe Cunningham could be in the Atlanta area or in Nashville, Tenn., where he has family. But Patterson believes someone here knows his whereabouts.

"Mr. Rucker was a family man, a husband and a father, and deserves to have justice for his murder," he said.

Cunningham joins a long list of fugitives on Rowson's Crime Scene as our Fugitive of the Week. Many of those fugitives have been captured because of their select status on that list.
