Too much to drink on New Year's? Get a free ride home

WOODSTOCK, Ga. -- If you party too much this New Year's Eve there are ways to get home safely.

Once again this year, Woodstock Police will provide free rides home for any resident who's had too much to drink at a city restaurant or bar.  They'll also arrange to have your car towed home.

The program is an effort to reduce the number of drunk drivers and drunk driving deaths during the holidays.

It's just one of several options open to party-goers.

11Alive has partnered with Checker Cab to provide free rides home on New Year's Eve.  Call 404-351-1111.  But be prepared to be patient.  It could take up to an hour for the cab to arrive during peak service hours.

You can also try AAA's "Tow to Go" program.  They'll provide a free ride for you and your car, whether you're a AAA member or not.

Atlanta guests robbed in hotel room

ATLANTA -- Atlanta police are looking for a man who robbed hotel guests in their own room. 

It happened at the Holiday Inn Express on Cone Street around 5 a.m. Monday.

According to a police report, a guest said a man came into his room and demanded his laptop, iPad and phone.

Atlanta police say while a crime like this is not common, thieves often target hotels and look for unlocked rooms.

The robbery came less than 48 hours before Tuesday's Chick-fil-A Bowl.

This year's game between Texas A&M and Duke University is the fastest sellout in the bowl's history.

David Wardell with the Downtown Improvement District says with 13 million people coming to events in downtown Atlanta every year, incidents of stranger on stranger crime are pretty low.

Wardell says ambassadors will be out in full force this weekend, to give directions and escort anyone to their destination.

Suicide bomber kills 15 at Russian train station

MOSCOW (USA TODAY) -- A suicide bomber struck a busy railway station in southern Russia on Sunday, killing at least 15 people and wounding scores more, officials said, in a stark reminder of the threat Russia is facing as it prepares to host the February Olympics in Sochi.

No one immediately claimed responsibility for the bombing in Volgograd, but it came several months after Chechen rebel leader Doku Umarov called for new attacks against civilian targets in Russia, including the Sochi Games.

Suicide bombings have rocked Russia for years, but many have been contained to the North Caucasus, the center of an insurgency seeking an Islamist state in the region. Until recently Volgograd was not a typical target, but the city formerly known as Stalingrad has now been struck twice in two months - suggesting militants may be using the transportation hub as a renewed way of showing their reach outside their restive region.

Volgograd, which lies close to volatile Caucasus provinces, is 550 miles south of Moscow and about 400 miles northeast of Sochi, a Black Sea resort flanked by the North Caucasus Mountains.

The bombing highlights the daunting security challenge Russia will face in fulfilling its pledge to make the Sochi Games the "safest Olympics in history." The government has deployed tens of thousands of soldiers, police and other security personnel to protect the Games.

Through the day, officials issued conflicting statements on casualties. They also said that the suspected bomber was a woman, but then reversed themselves and said the attacker could have been a man.

The Interfax news agency quoted unidentified law enforcement agents as saying that footage taken by surveillance cameras indicated that the bomber was a man. It also reported that it was further proven by a torn male finger ringed by a safety pin removed from a hand grenade, which was found on the site of the explosion.

The bomber detonated explosives in front of a metal detector just beyond the station's main entrance when a police sergeant became suspicious and rushed forward to check ID, officials said. The officer was killed by the blast, and several other policemen were wounded.

"When the suicide bomber saw a policeman near a metal detector, she became nervous and set off her explosive device," Vladimir Markin, the spokesman for the nation's top investigative agency, said in a statement earlier in the day. He added that the bomb contained about 22 pounds of TNT and was rigged with shrapnel.

Markin later told Interfax that the attacker could have been a man, but added that the investigation was still ongoing. He said that another hand grenade, which didn't explode, was also found on the explosion site.

Markin argued that security controls prevented a far greater number of casualties at the station, which was packed with people at a time when several trains were delayed.

Earlier in the day, Lifenews.ru, a Russian news portal that reportedly has close links to security agencies, posted what it claimed was an image of the severed head of the female attacker. It said the attacker appeared to have been a woman whose two successive rebel husbands had been killed by Russian security forces in the Caucasus.

Female suicide bombers, many of whom were widows or sisters of rebels, have mounted numerous attacks in Russia. They have been referred to as "black widows."

In October, a female suicide bomber blew herself up on a city bus in Volgograd, killing six people and injuring about 30. Officials said that attacker came from the province of Dagestan, which has become the center of the Islamist insurgency that has spread across the region after two separatist wars in Chechnya.

As in Sunday's blast, her bomb was rigged with shrapnel that caused severe injuries.

Chechnya has become more stable under the grip of its Moscow-backed strongman, who incorporated many of the former rebels into his feared security force. But in Dagestan, the province between Chechnya and the Caspian Sea, Islamic insurgents who declared an intention to carve out an Islamic state in the region mount near daily attacks on police and other officials.

Rights groups say that authorities' tough response of arbitrary arrests, torture and killing of terror suspects has fueled the rebellion.

The Kremlin replaced Dagestan's provincial chief earlier this year, and the new leader abandoned his predecessor's attempts at reconciliation and efforts to persuade some of the rebels to surrender in exchange for amnesty.

Security camera images broadcast by Rossiya 24 television showed Sunday's moment of explosion, a bright orange flash inside the station behind the massive main gate followed by plumes of smoke.

A witness, Roman Lobachev, told Rossiya television that he was putting his bags on a belt for screening when he heard the sound of an explosion. "I heard a bang and felt as if something hit me on the head," said Lobachev, who survived the attack with minor injuries.

The bombing followed Friday's explosion in the city of Pyatigorsk in southern Russia, where a car rigged with explosives blew up on a street, killing three.

Following Sunday's explosion, the Interior Ministry ordered police to beef up patrols at railway stations and other transport facilities across Russia.

Russia in past years has seen a series of terror attacks on buses, trains and airplanes, some carried out by suicide bombers.

Twin bombings on the Moscow subway in March 2010 by female suicide bombers killed 40 people and wounded more than 120. In January 2011, a male suicide bomber struck Moscow's Domodedovo Airport, killing 37 people and injuring more than 180.

Umarov, who had claimed responsibility for the 2010 and 2011 bombings, ordered a halt to attacks on civilian targets during the mass street protests against President Vladimir Putin in the winter of 2011-12. He reversed that order in July, urging his men to "do their utmost to derail" the Sochi Olympics, which he described as "satanic dances on the bones of our ancestors."

A group calling itself Anonymous Caucasus said in a statement Friday on the Caucasus rebel website, kavkazcenter.com, that it would launch cyber-attacks to avenge Russia's refusal to acknowledge the 19th-century expulsion of Chirkassians, one of the ethnic groups in the Caucasus.

The International Olympics Committee expressed its condolences over the bombing, but said it was confident of Russia's security preparation for the games.

"At the Olympics, security is the responsibility of the local authorities, and we have no doubt that the Russian authorities will be up to the task," it said in a statement.

Russian authorities have introduced some of the most extensive identity checks and sweeping security measures ever seen at an international sports event.

Anyone wanting to attend the games, which open Feb. 7, will have to buy a ticket online from the organizers and obtain a "spectator pass" for access. Doing so will require providing passport details and contacts that will allow the authorities to screen all visitors and check their identities upon arrival.

The security zone created around Sochi stretches approximately 60 miles along the Black Sea coast and up to 25 miles inland. Russian forces include special troops to patrol the forested mountains towering over the resort, drones to keep constant watch over Olympic facilities and speed boats to patrol the coast.

The security plan includes a ban on cars from outside the zone starting a month before the games begin until a month after they end.

Missing 6-year-old Florida girl found in Perry, GA

Police say Ominka Fisher (L) was abducted by Charity Chapman (R).

JACKSONVILLE, Fla. -- The Sheriff's Office in Jacksonville, Fla. says a missing 6-year old girl has been found in Georgia.

The girl, Onnika Fisher, has been located unharmed. The sheriff's announcement says she and her mother, Charity Chatman, were located on a traffic stop in Perry, Ga. Ms. Chatman was arrested on the outstanding warrant for Interference With Custody.

The Georgia Bureau of Investigation had issued a Levi's Call, Georgia's Amber Alert, for the girl on Sunday.

Officials said the child and her mother were believed to be in a 2000 Dark Green Buick Century with Ohio tag FPA4958.

$200K FBI reward for suspect who killed officer

ATLANTA -- The FBI is currently offering a reward of $100,000, with a total combined reward of over $200,000, for information leading to the capture of this individual who is considered armed and extremely dangerous.

Acting Special Agent in Charge Ricky Maxwell, FBI Atlanta Field Office, requests the public's assistance in identifying and locating the individual responsible for the attempted armed robbery of the Bank of America, located at 2625 Piedmont Road.

On Monday, Dec. 23, at approximately 9:30 a.m., a lone male wearing a black ski mask and armed with a semi-automatic handgun entered the Bank of America and initially demanded money from a bank teller. 

The robber, unsuccessful in his robbery attempt, made the same demand from a customer at an ATM machine located in the vestibule of the bank. After obtaining an undisclosed amount of money from the customer, the robber departed the bank without further incident. He was observed departing in a light grey vehicle, possibly a Chrysler 200, with no license plate displayed.

The robber is described as a light skinned male, race undetermined, wearing a black ski mask, grey/white striped long sleeve shirt, black gloves, light or grey tennis shoes/possibly Chuck Taylor Converse shoes, and a black semi-automatic handgun, possibly a Sig Sauer .45 caliber.

This individual is now believed to be the same armed robber responsible for the violent armed robbery of a Tupelo, Mississippi bank that occurred later that same day and the resulting ambush style shooting of two Tupelo Police Officers. Officer Gale Stauffer, one of the two officers, died of those wounds received by the robber.

Police: Gwinnett teens victimized by foreign sexting sites

Lawrenceville, GA. -- Gwinnett Police are warning parents and students they're seeing more and more sexting pictures posted online-and there's nothing they can do about it.  

In the past, when pictures were posted on Instagram or Facebook, local police had legal avenues they could take.  Those sites, with US-based servers holding their information, are usually compliant.  Corporal Jake Smith said in one recent case, they easily had the photo removed from Instagram. 

"Unfortunately, the same photo then made its way onto a site hosted in China," Smith said.  "And we don't have any recourse as far as taking that down or requiring them to give us data on who posted that photo."

Hacking expert Gregory Evans said only novice internet business owners keep their sites in the US.  Most experienced website owners have faced lawsuits and subpoenas, and reacted. 

"They've learned from their mistakes and they've now moved all their servers overseas," Evans said.  "Not just China but India, Pakistan, even South America."

Evans said in those cases, the sites are often supplied by an ex who posts sexted pictures of their former significant other.  The sites post them and charge a fee for their removal.  But oftentimes, once that fee is paid, the pictures show up on other sites. 

Evans said that's because many of the sites have the same owner.  Once they see a victim is willing to pay, they'll take advantage as often as they can.  Local and even federal law enforcement officers have very little recourse under current laws. 

"Mostly we just need teens and parents to be aware that once these photos go out, there's no getting them back," Smith said. 

Evans says there are private ways to get the pictures removed.  He takes on clients at Hackersforhire.com.   But even he can't guarantee the pictures won't live on in some dark corner of the world wide web.

"Someway, somehow it will always be out there- and that's the scary part," Evans said.

Juvenile arrested in Kirkwood shooting

ATLANTA -- A juvenile suspect has been arrested Saturday morning for his involvement in the Kirkwood shooting that took place Thursday evening. 

The suspect is a juvenile and therefore his name and information will not be released. The investigation is still active and ongoing. 

The juvenile has been charged with one count of murder and one count of armed robbery. 

Two men were shot while walking through Atlanta's Kirkwood neighborhood Thursday evening.

Friday morning, Atlanta police confirmed that one of the victims died of his injuries.  He was 21 year old Xavier Arnold.

The shooting happened at around 5:40 p.m. Thursday on Rogers Street NE.

Atlanta police spokeswoman Kim Jones said two men and a woman were walking down the street when they were approached by two suspects. The suspects got into a fight with the two male victims before shooting them. The woman was not hurt.

One of the victims was shot in the leg, while Arnold was hit in the head. Jones said Arnold died overnight at Grady Memorial Hospital.

Jones said the two suspects ran after the shooting and are still at large.

There is a $5,000 reward for anyone that can help capture the suspects.

2 shot, 1 fatally, in Kirkwood

7 arrested for MARTA Breeze Card fraud

ATLANTA -- MARTA police have arrested seven people they say sold counterfeit Breeze cards, a scheme that could have earned them a hefty profit before they were caught.

MARTA says the thieves spent $1 to buy the Breeze card, then reprogrammed the data on it to turn it into a 30-day pass.

They then sold it to riders for $40, a deep discount of the real price of $96. That meant the thieves got to pocket $39, and the buyers got a cheap ride.

Police are warning anyone who purchased the cards that even possession is a crime. They don't anticipate arresting anyone who bought a counterfeit cards, but they do need information on where it was purchased and a description of who sold it.

Since December 10th, police have arrested 22-year old Pierre Metteaux, 34-year old Jedadia Byrd, 45-year old Melvin Summers, 44-year old Christina Carney, 26-year old Stephanie Finger, 42-year old Brenda Small and 33-year old Michael Dallas.

Investigators say as they learn more about the groups distribution circle, more arrests will follow.

MARTA police chief Wanda Dunham says the cards were sold at MARTA stations and on Craigslist. But it was a suspicious buyer who purchased one at an area mall that contacted police.

"He knew that wasn't the right fare so he called us, asked us to check into it," said Dunham.

As they investigated, the agency's Revenue Department noticed in November, a large number of cards were sold at its Chamblee and Lenox stations for only a dollar. 

Police started reviewing surveillance video to create a list of suspects. 

MARTA won't say how many counterfeit cards the group sold, but says during the arrests it confiscated 400 fraudulent cards.

Had the thieves sold them, their $400 initial investment, would have earned them $16,000. 

MARTA says it's never had something like this happen before, but security expert Gregory Evans says MARTA needs to act fast, if wants to keep it from happening again. 

He says the hackers likely got away with their scheme using a simple card writer that costs just a few hundred dollars.

"The crazy part, the scary part about this? MARTA would have never known if some had not gone back and told them what was happening. That's it," said Evans.

Evans says the data on the card could be encrypted and an alert built into their software system.

"If I go to use this card somewhere and all the sudden there's $100 on this card, their system should have caught that and said hold up," Evans said.

MARTA won't say how it's improving the system, only that its working with the FBI.

The 10 worst and best store return policies

ATLANTA -- 'Tis the season to return. If you find yourself with a gift you'd like to exchange or have replaced with cash, today I have you covered. Returns happen; it's just part of the retail world and I don't think you should be penalized in that event.

Today you'll find my list of the stores that have the best and worst return policies. Do you have a favorite store that's not on the list? I'd love to hear your comments.

Who made the good list?

1) Nordstrom

Why? It's refreshing to find a store that not only offers free shipping, but pays return shipping on all returns, all the time. Their customer service is also superb in all my tests. Granted, this is not a store where many of us can afford to shop.

2) Costco

Why? You don't even need a receipt. All purchases are tied to your membership and Costo will refund you all shipping and handling charges. Costco also has a 90 day return window on electronics which is far better than most competitors.

3) Kohl's

Why? They will take back any time, any time whether or not you have a receipt. Any store that makes it this easy gets two huge thumbs up. Now only if they'd improve on their online shipping cost minimums!

4) Zappos

Why? Most people think I'm crazy when I recommend a shoe purchase online but this fine foot retailer gives you an entire year to return any unwanted item. They even pay for return shipping.

5) Amazon

Why? Although the return windows are not always as long as I'd like, their web-based customer service is phenomenal, their return center could not be easier to use and they give most other e-tailers a run for their money.

6) Target

Why? They promise to attempt a return on every purchase, even those without a receipt, which is rare to see. They have a generous 90-day return window and will accept returns for anything purchased online in an actual store (rather than making you ship it back to the e-warehouse from which it shipped).

7) Macy's

Why? They place few limits on any type of return or change and will attempt returns at any time . The one caveat: gifts can't be returned for cash, you get the value of that return on a gift card.

Who made the naughty list?

1) Most Daily Deal Sites

Why? Most daily deal sites don't accept returns unless an item is defective, and at that point, it's for a replacement, not a refund. I truly can't fault daily deal sites for their return policies. They operate with razor thin profit margins which allow for the biggest price drops and deals, and also some unfortunately lousy return policies.

2) Best Buy

Why? For a great store that makes purchasing so easy, their tiered return policy is overly complicated.

Some products have 15 days, other produces like computers and tablets have a 30 day return policy. And although Best Buy has an extended holiday return policy, their regular policy frustrates me. I don't like the fact that returns are extended for Best Buy Elite and Elite Plus members. I think all shoppers should be treated equally. I also don't like the "Best Buy reserves the right to deny any return or exchange" mission statement. While I realize all stores have that policy in place, even Target suggest they'll "attempt a return" in returns disclaimer.

3) Walmart

Why? Despite wonderful prices and rapidly improving customer service, Walmart's return policies could not be more complex or confusing.

Every department has a different return policy:
CDs and books: 90 days
Video game hardware: 15 days
Pre-owned video game software: 90 days
Tablets: 15 days
Lawn mowers: 30 days

You need a chart just to understand what's going on.

From eight thousand miles away, a special holiday homecoming

MARIETTA, Ga. -- On the day after Christmas, the Payne family is the picture of holiday happiness.

But what the family portrait doesn't show is what it took to get there.

When Ellyce Payne graduated from the University of North Georgia last spring, she wanted to branch out. So she headed to Tanzania, more than eight thousand miles away from home, to teach English to schoolchildren.

This would be her first Christmas away from home.

"She was supporting me, but I could tell that it was not easy for her," Ellyce said of her mother, Laura Payne.

Laura never let on, but the thought of Christmas without her oldest girl was downright painful.

"I lost my mother and father and I was just very sad," Laura Payne said through tears. "I just didn't want her not to be here."

The problem was airfare. A ticket from Tanzania to Atlanta would easily run more than $3000. 

But with Christmas fast approaching, Ellyce kept searching. Finally, a plane ticket was within reach.

"I messaged my dad and said, 'I think I found a flight, I think I can get home -- and let's make this a surprise!'" she remembered.

And that's why on Christmas Eve, just as Laura had finished wrapping the last of the presents, Santa came with a special gift for her -- in the form of her little girl.

"When I realized it was her, I just said 'I can't believe it's her!'" she said. "All of my prayers have been answered!"

On a whim, her husband, Ed Payne, put the video on YouTube. As of Thursday night, the video was closing in on three thousand hits.

"When you really, really want something and it can't happen, we've all been there," Laura said. "And then when it happens, it's a wonderful Christmas miracle."

Christmas bandits steal newlyweds' presents

ATLANTA -- A Christmas bandit or bandits nearly ruined an Atlanta newlywed couple's first Christmas together.  The thieves broke into the couple's East Atlanta home and stole all their Christmas presents.

"I don't understand how someone could have the mentality where they break into someone's house in the middle of the day on Christmas eve," homeowner Katherine Blair said.

Katherine says she returned home from her shift at a local hospital where she works as a nurse to discover that someone had kicked in her front door.

Katherine says the thieves stole her TV, her laptop and all the Christmas presents she wrapped the day before.

Katherine says she and her husband were married in May. Most of what the thieves stole, Katherine said, was framed photographs from the couple's wedding that they planned to give as Christmas gifts.

Katherine says she believes the thieves likely mistook the gifts for high-end electronics.

A very merry Christmas around metro Atlanta

ATLANTA -- From feeding the hungry to feeding the soul... Atlantans celebrated a very merry Christmas Wednesday.

Downtown, hundreds of volunteers made sure thousands of families got a meal during Hosea Feed the Hungry's annual Christmas Day feast.

And in Conyers, Henry County police spent the night creating a white Christmas for a little boy.

Civil Rights Leader John Lewis gives unique gift to members of Congress

Congressman and civil rights icon John Lewis (D-Atlanta) gave his fellow members of Congress a unique Christmas present this holiday.

Lewis gave every member of Congress a copy of the graphic novel, "The March." The comic book chronicles Lewis' childhood and involvement in the civil rights movement.

The graphic novel begins with a pivotal moment in the civil rights struggle - the 1965 March to Selma, Alabama. Lewis was seriously injured when he was hit in the head by a police baton by Alabama State troopers who were attempting to disperse the march.

"We were disciplined," Lewis said. "We were prepared to be jailed, to be beaten, to suffer." Even so, Lewis says he was largely unprepared for the violence he faced that day.

"I thought I was going to die," Lewis said.

Lewis says he was inspired to join the civil right movement after listening to Martin Luther King Jr. on the radio as a child. Lewis would later meet Dr. King as a college student in Tennessee. Lewis says the meeting was life-changing.

He would soon join Dr. King on the front lines of the civil rights movement, fighting desegregation.

Yes, Santa, there IS a free lunch, in Douglasville

DOUGLASVILLE, Ga. -- They say there's no such thing as a free lunch.

Well, that certainly wasn't the case at Douglas County's Bankhead Diner this Christmas Eve.

In fact, owner Jennifer Guy gave away hundreds of them, no questions asked.

After 15 years in business, she began her Christmas Eve lunch giveaway four years ago as a way to say thanks to her regular customers and to help those in need.

"Me and my son decided we'd do something for the county; we've been here and they've been with us, so we wanted to give something back," she told 11Alive News on Tuesday.

Hundreds showed up, some drove, some walked, some got free rides for a holiday lunch of turkey, ham and all the Christmas trimmings, for a visit with Santa and, if needed, for some free clothing and toys.

A small army of volunteers said it's often the best part of their Christmas.

"It humbles you for sure," said volunteer Natalie McCannon. "You don't realize how many people just in this area there is that need."

"We don't have a whole lot of money, but we at least volunteer our time and give something back to the community," added volunteer Claudette Moore.

Some of the volunteers also took meals to nearby nursing homes.

Many brought their children and grandchildren to teach them the meaning of helping and the reason for the holiday.

Guy said it's all worthwhile when she sees the smiles of families who otherwise might not have a Christmas celebration.

"To see the people come in with their little children and eat and carry clothes out in boxes, just carry 'em out in boxes, that means a lot," she said.

'Consumer Reports' picks worst new car values

(USA TODAY) -- The Nissan Armada gets only 13 miles a gallon, has terrible scores on the reliability survey and costs $1.20 a mile to operate.

It's that record that earned the big SUV and nine other vehicles spots on Consumer Reports' list of worst automotive values. While the magazine combed through its reviews and surveys to pick the nation's best, it also reserved a special place at the bottom for the worst in each automotive category.

Besides Armada, Nissan also gets another worst with the Altima sedan with a 3.5-liter engine in the midsize car category. All of the lowest of the low were culled from among 200 different models.

Consumer Reports' point is that a cheap car isn't necessarily a good value. It notes that a Nissan Versa costs about $1,500 less than rival subcompact Honda Fit. But the Fit "fun to drive, cheaper to own, more reliable and provides almost twice the value," says Automotive Editor Rik Paul in a statement.

And Versa is not even the worst value for a subcompact car. That (dis)honor goes to the Volkswagen Beetle with a 2.5-liter engine.

Fire makes family homeless before the holidays

TUCKER, Ga. -- The holidays make us all appreciate family, friends and a warm roof over our heads, but we must also remember the folks who experienced tragedy, illness or perhaps the loss of their home during the holidays.

One metro Atlanta family's house was destroyed by fire. And the Bogle family recently learned they could be homeless before the start of the new year.

"It's still so surreal," said Tiffany Bogle.

She took 11Alive inside what's left of the place she once called home in Tucker.

"It's like a tornado hit this house," she said.

It would be a twister of flames, however, that would leave most of the place in ashes and charred rubble.

The home we don't own, but the belongings in it -- is the only thing we have," Bogle said. "It was an electrical fire."

The fire started in her daughter's bedroom.

"My daughter's mattress caught on fire when she reset the breaker -- a spark jumped from the outlet and hit her mattress," Bogle said.

The 20-year-old college student did what anyone would do in an effort to save the house.

"She attempted to pull the mattress outside, and she did, but the fire caught on to the porch and it rolled back into to the home," Bogle said.

The fire displaced the family for weeks, forcing them to spend Thanksgiving and now Christmas inside a motel room.

"It's hard. It's really hard," Bogle said.

To make matters worse, the family must be out of the motel by the end of the year.

"Our last day here at the hotel is the 31st. And I was told by my adjustor -- she will not extend after this last extension," Bogle said.

They have renters insurance, but the money is not enough to secure a new place to stay. And with no relatives living in Georgia, time is simply running out.

"I just know that I need to get my family a home so we can get back to some type of normalcy," Bogle said.

Douglas Co. Sheriff bans A&E filming over Duck Dynasty controversy

DOUGLAS COUNTY, GA - Maybe it's because he's not running for re-election after 43 years in law enforcement, the last 16 as Douglas County Sheriff, but Phil Miller is making national headlines for jumping into the Duck Dynasty controversy.

Specifically, he is hitting back against the Arts and Entertainment network after it suspended Duck Dynasty star Phil Robertson for some anti-gay comments in a recent GQ Magazine article.

"In my opinion he was being punished because he believed in the Bible," Miller told 11 Alive News on Monday.

Miller said he shares the same beliefs Robertson expressed about a book prominently displayed on his desk.

"That's my belief in Christianity and my belief in the Bible and my belief that people ought not be punished for their belief," Miller said.

In retaliation for Robertson's suspension, Sheriff Miller is cutting ties with A&E's Scared Straight program, which has filmed several episodes in his jail.

"To me it was a tool to add some credence to what I was saying and let everybody know that I meant what I was saying," he explained.

Miller's Facebook page has drawn comments from all over, mostly supportive, but some condemning him as well.

"Those people have the right to say that just like I hope I have the right to say what I said," he added.

Meanwhile, Cracker Barrel restaurants changed their minds Sunday about banning Duck Dynasty merchandise from their gift shops after a storm of protests, saying, "You told us we were wrong. We listened."

Entertainment Weekly also posted a weekend story that Robertson may soon return to the hugely popular TV show, but so far, that hasn't been confirmed.

In his first interview since being suspended, Robertson told MailOnline Sunday that he will not apologize for condemning the sin and not the sinner.

Sheriff Miller agrees.

"As a Christian, I believe that if I hate you for what you do or for what you are I don't believe I can go to Heaven either," he added.

Heat fatalities in December a major concern

Beat the Heat, Check the Backseat is a campaign from the National Weather Service to remind people not to leave their children in a hot car. 

Georgia ranks 8th in the country for heat related deaths in cars for children, but what's surprising is that it's happening at a time of year when hot temperatures usually are not a factor.

"What was really heartbreaking was when we started looking at the ages of these people that were dying, these were young kids," explains Trisha Palmer, meteorologist at the National Weather Service.


We all know to not leave our kids or pets in a car on a 90 degree day, but what about a 70 or 60 degree day?

"As we started digging down further I was seeing deaths from heat as early as April and as late as December," states Palmer. "Well how are these children dying? Cause it wasn't like it was really hot outside, it was 70s outside. So I cross-referenced my database with a database that keeps track of heat stroke deaths in children....we found that yes, all these deaths of children early in the year and late in the year were in vehicles."

The temperature in a car can rise 20 degrees in just 10 minutes, 30 degrees in 20 minutes, and 40 degrees in less than an hour. (G3)
Once the car reaches 104 degrees, heat stroke sets in. So, if the temperature outside if 64 degrees or higher... leaving them inside is usually fatal.

Here's the temp outside the car, it's 47 degrees. Inside the car, the temperature is 66 degrees. If the outside temperature is in the upper 60s, as it sometimes can be in December, that means if you run in to a store for just 35 minutes, your child to succumb to heat stroke in that short period of time.

"50 precent of the childrens deaths in vehicles are because they were forgotten or left by a caregiver," Palmer describes. "Another 30 precent were because they actually gained access to the vehicle themselves and were playing in it, and either succumbed before they realized it, or couldn't get out, they got trapped in the vehicle."

Meaning 80 percent of these deaths could have been prevented by simply checking the backseat of the car.

Falcons fall to 49ers on Monday Night Football

SAN FRANCISCO (AP) - NaVorro Bowman returned an interception 89 yards for a touchdown with 1:10 remaining, and the San Francisco 49ers clinched a playoff berth with a wild 34-24 victory against the Atlanta Falcons on Monday night in the final regular-season game at Candlestick Park.

Tramaine Brock broke up a pass intended for Harry Douglas and Bowman got his hands on the ball and took off, then received a celebratory dog pile from teammates in the end zone.

Matt Ryan threw a 39-yard touchdown pass to Roddy White with 8:42 remaining and a 2-yard score to Tony Gonzalez with 2:09 left as the Falcons (4-11) made things interesting until the end.

Atlanta's Jason Snelling recovered the ensuing onside kick as the Falcons got the ball back and were driving for a potential go-ahead score when San Francisco (11-4) capitalized with one of its biggest takeaways yet.

Some Rivers, Creeks and Streams Overflowing

The rain is still coming down.  Many rivers, creeks and streams are already flowing over their banks.  A flood watch continues for all of metro Atlanta and north Georgia.  There are some flood warnings for some of those areas where creeks and streams can no longer hold all of the water that is running off into them.

The picture shows a hydrograph of Big Creek in Alpharetta.  Look at the sharp rise in the water level this morning as the heavy rain moved in.  Big Creek is above flood stage and is continuing to rise.  It is expected to stay in the "minor flooding" category.  Big Creek in Cumming is also in "minor flood."

The Etowah River in the Canton area is above flood stage.  

The Euharlee Creek in Rockmart is above flood stage.

The Tallapoosa River in west Georgia is above flood stage.

The Coahulla near Dalton is above flood stage.

The Conasauga River near Eton in northwest Georgia is above flood stage.

All of the above rivers are are experiencing minor flooding.  More rain is coming in tonight into Monday morning.  These creeks and streams will continue to rise with more water running off into them.  All are forecast to stay below "moderate" flooding criteria.  

There are other rivers, creeks and streams that are near flood stage.  We will be watching all of these for any additional warnings that may be issued.

The NWS has also issued what is called "areal" flood warnings for many areas.  These "areal" flood warnings aren't for a specific creek or stream, but for any flood prone areas in the county that can't handle all of the water piling up.  Those "areal" flood warnings are in effect for Gordon, Floyd, Cherokee, Cobb, Gilmer, Dawson, Forsyth, Lumpkin and Haralson counties.

Sunday Evening Weather Update

More rain will be with us tonight.  The feed of moisture from the Gulf of Mexico will continue pumping rain into our area.  Showers will continue this evening and overnight.  Temperatures will hold in the 50s toward morning.

The rain will stick with us through the morning hours Monday.  The back edge of the rain shield will eventually push to the east.  The rain will taper off around lunchtime into the afternoon.  We may even see the clouds break up a little before it sets.  There won't be a wide range of temperatures.  We will hold in the 50s all day.

We will clear out Monday night with cold air moving in.  Lows by Tuesday morning down to around the freezing mark.  We won't warm too much on Christmas Eve.  Highs will only be in the mid 40s.

Christmas Day will be cold, too.  We will start off Christmas morning with temps in the mid 20s.  Highs in the afternoon will hold in the 40s.

We eventually get back to the 50s by the end of the week into the weekend with a good bit of sunshine.

Three shot and killed in Cobb County apartment

Marietta, GA--  Cobb County Police are investigating  a triple shooting inside an apartment.

It happened around 2:30 Sunday afternoon at the Ivy Ridge Apartments off Bentley Road.

According to spokesman Sgt. Dana Pierce the whole incident was contained within one apartment.

"Everything was contained here inside the apartment. Initially there was speculation that people were missing from this immediate scene. That was not the case," said Pierce.

Pierce said there were "several witnesses" to the crime. They were taken to police headquarters to be questioned.

Neighbors say the victims are a husband and wife and another adult man.  They say they are part of a close knit Brazilian community in the area.

Target offers 10% discount after credit card hack

NEW YORK (CNNMoney) -- A day after Target announced that forty million of its customers had their credit and debit card data breached, the retailer announced a 10% discount for all shoppers at its stores this Saturday and Sunday.

"We recognize this has been confusing and disruptive during an already busy holiday season," Target CEO Gregg Steinhafel said in a statement Friday. "Our guests' trust is our top priority at Target and we are committed to making this right."

The company also provided details Friday about the extent of the hack and the information that could have been compromised.

The nation's No. 2 general merchandise retailer said cards used at its brick-and-mortar stores between Nov. 27 and Dec. 15 of this year may have been impacted.

Target said there is no indication that any debit card PIN numbers were compromised. The retailer also claimed it doesn't appear that the three- or four-digit security code visible on the face of credits cards were breached. That means that the debit and credit cards that were compromised cannot be used to withdraw cash from an ATM or to shop online.

But lawyer Robert Ahdoot, part of a legal team in California that has filed a lawsuit seeking class action status on behalf of Target customers, said he had spoken to shoppers who claimed thieves had used their debit card information to withdraw money from ATMs.

The lawsuit alleges negligence on the part of the retailer, and also says Target failed to promptly notify victims of the hack.

"Target has an obligation to provide adequate security for the financial information they collect," Ahdoot said. He recommended that consumers who suspect that their cards may have been compromised change their PIN numbers as a precaution.

Target spokeswoman Molly Snyder said the retailer "typically doesn't comment on pending litigation."

Target said it believes customers' birth dates and social security numbers weren't compromised. The retailer said it gave Visa, MasterCard, Discover and American Express the card numbers of those who may have been impacted, and that these companies will monitor the cards for fraud.

Target is also monitoring its own card, the REDcard, for potential unauthorized activity.

Steinhafel said the affected customers "will not be held financially responsible for any credit and debit card fraud."

"[T]o provide guests with extra assurance, we will be offering free credit monitoring services," Steinhafel said. "We will be in touch with those impacted by this issue soon on how and where to access the service."

To help answer questions about the incident, Target has set up a hotline for customers. Shoppers have been reporting long hold times, so Target said it will beef up its staffing.

Target didn't specify how its systems were hacked. But judging by the scope of the breach and the kind of information that criminals obtained, security experts say hackers apparently targeted the retailer's point-of-sale system. That means they either slipped malware into the terminals where customers swipe their credit cards, or they collected customer data while it was en route from Target to its credit card processors.

The retailer said it had notified authorities and financial institutions immediately after it was made aware of the unauthorized access, and had hired a forensics team to investigate how the breach may have occurred. The issue that allowed the breach has been identified and resolved, Snyder said.

Colorado high school shooting victim dies at hospital

(CNN) -- Claire Davis, the 17-year-old high school senior shot by a classmate at their Colorado school, died Saturday at the hospital where she was being treated.

"It is with unspeakable sadness that we write and say that Claire has passed away from the gunshot wound she received at Arapahoe High School on December 13," her family said in a statement posted on the Facebook account of Littleton Adventist Hospital.

"Although we have lost our precious daughter, we will always be grateful for the indelible journey she took us on over the last 17 years -- we were truly blessed to be Claire's parents. The grace, laughter and light she brought to this world will not be extinguished by her death; to the contrary, it will only get stronger."

Davis was killed after Karl Pierson, 18, according to police, walked into Arapahoe High School armed with a pump-action shotgun, a machete and a backpack containing three Molotov cocktails, a bandolier of ammunition across his chest.

He shot Davis once in the head and fired randomly into school hallways. Police said Pierson was looking for revenge against a librarian, but couldn't find the faculty member and killed himself as a school resource officer closed in.

Davis did not know Pierson and was just a random victim, police surmised. She had been in a coma since the shooting.

Davis was described as a sweet girl who loved horses and the English boy band One Direction.

After friends started a Twitter campaign, the band recorded a 13-second video message and sent it directly to the Davis family, a source close to One Direction told CNN on Thursday. The video shows singer Liam Payne delivering the message as the other four members stand by.

The hospital said Davis died at 4:29 p.m.

The family's message on Facebook thanked the hospital staff, first responders and law enforcement officers.

"Last week was truly a paradox in that we lost our daughter, yet we witnessed the wonderful love that exists in the world through the tremendous outpouring of support we received," the family said.

Pierson's parents issued a statement last week.

"We cannot begin to understand why Karl did what he did," Barbara and Mark Pierson said. They also offered prayers "for the entire Arapahoe High School community, as we know your lives are forever changed by this horrific event."

Hundreds of people attended a vigil for Davis last Saturday.

The shooting happened about 10 miles from where Eric Harris and Dylan Klebold killed 12 students and one teacher in a rampage at Columbine High School in April 1999 before killing themselves.

Sunday Weather Outlook

A tornado watch remains in effect through 3am Sunday for Alabama, Tennessee and Kentucky.

The Storm Prediction Center continues with a "moderate" risk for Louisiana, Mississippi, Tennessee and northwest Alabama.  The "slight" risk extends into northwest Georgia for overnight into early Sunday morning.  

So far, the worst of this system looks like it will be to the west of us.  The line will move east overnight tonight into Sunday morning. It will weaken as it moves in.  We don't think the storms will be as strong over us as they are to the west.  However, as the storms weaken, some of them could be strong enough to producing some damaging winds and maybe even an isolated tornado.

The timing of this system brings the line into NW Georgia between 4am and 6am Sunday morning.  It moves into the metro area between 9am and 12pm.  The rain will stick with us through the afternoon.  We could pick up between 1 and 3 inches before it all moves out later on Monday.  There is also a Flood Watch in effect through Monday morning.  If you live near a river, creek or stream, or if you are in a flood prone area, watch for rising water.

NEW YORK (CNNMoney) -- A day after Target announced that forty million of its customers had their credit and debit card data breached, the retailer announced a 10% discount for all shoppers at its stores this Saturday and Sunday.

"We recognize this has been confusing and disruptive during an already busy holiday season," Target CEO Gregg Steinhafel said in a statement Friday. "Our guests' trust is our top priority at Target and we are committed to making this right."

The company also provided details Friday about the extent of the hack and the information that could have been compromised.

The nation's No. 2 general merchandise retailer said cards used at its brick-and-mortar stores between Nov. 27 and Dec. 15 of this year may have been impacted.

Target said there is no indication that any debit card PIN numbers were compromised. The retailer also claimed it doesn't appear that the three- or four-digit security code visible on the face of credits cards were breached. That means that the debit and credit cards that were compromised cannot be used to withdraw cash from an ATM or to shop online.

But lawyer Robert Ahdoot, part of a legal team in California that has filed a lawsuit seeking class action status on behalf of Target customers, said he had spoken to shoppers who claimed thieves had used their debit card information to withdraw money from ATMs.

The lawsuit alleges negligence on the part of the retailer, and also says Target failed to promptly notify victims of the hack.

"Target has an obligation to provide adequate security for the financial information they collect," Ahdoot said. He recommended that consumers who suspect that their cards may have been compromised change their PIN numbers as a precaution.

Target spokeswoman Molly Snyder said the retailer "typically doesn't comment on pending litigation."

Target said it believes customers' birth dates and social security numbers weren't compromised. The retailer said it gave Visa, MasterCard, Discover and American Express the card numbers of those who may have been impacted, and that these companies will monitor the cards for fraud.

Target is also monitoring its own card, the REDcard, for potential unauthorized activity.

Steinhafel said the affected customers "will not be held financially responsible for any credit and debit card fraud."

"[T]o provide guests with extra assurance, we will be offering free credit monitoring services," Steinhafel said. "We will be in touch with those impacted by this issue soon on how and where to access the service."

To help answer questions about the incident, Target has set up a hotline for customers. Shoppers have been reporting long hold times, so Target said it will beef up its staffing.

Target didn't specify how its systems were hacked. But judging by the scope of the breach and the kind of information that criminals obtained, security experts say hackers apparently targeted the retailer's point-of-sale system. That means they either slipped malware into the terminals where customers swipe their credit cards, or they collected customer data while it was en route from Target to its credit card processors.

The retailer said it had notified authorities and financial institutions immediately after it was made aware of the unauthorized access, and had hired a forensics team to investigate how the breach may have occurred. The issue that allowed the breach has been identified and resolved, Snyder said.

Atlanta homeless men's choir inspires audiences

ATLANTA -- They stood in matching blue shirts warming up to sing in 11Alive Studio B. "Where should we look?" one nervously asked. "I'd prefer you look at me!" choir director Donal Noonan said to a spattering of laughs. 

Those smiles came after taking goofy behind-the-scenes photos and getting polished up by makeup artists.

These behind-the-scenes photos were taken at the 11Alive Studios where the men recorded two songs to air Thursday morning. Seeing them sing was an inspiring experience we wanted to share with you!

Noonan started The Atlanta Homebound Men's Choir in November just after he started at The Catholic Shrine of the Immaculate Conception. "I passed by the state capitol every day," he told 11Alive's Julie Wolfe. "And I saw those men. They looked like they were waiting for something to happen."

The seven men meet for practice every Tuesday and Thursday. They're living at the Central Night Shelter. 

Thursday evening, 11Alive's Jaye Watson will take viewers behind the scenes of the choir and what it means to the men struggling to get off the streets.

All of it leads to their first Christmas concert Sunday, December 22. It's at 5 p.m., at The Shrine of the Immaculate Conception Catholic Church.

MARTA pioneers urine detectors in elevators

ATLANTA -- The state, or rather smell, of MARTA's elevators has become the subject of many bad jokes over the years.

Just ask anyone who often uses those elevators about the practice of some riders to use them as bathrooms.

"Whoa, it smells like the stench of hell," rider Valerie Mitchell told 11Alive News on Thursday.

"Pathetic, it makes me nauseated, I mean it's just sickening," said rider Angela Trim.

"Sometimes they smell horrible, they are horrible," added rider Willie Freeman.

Since he uses an electric scooter to get around, Freeman has no choice but to use the MARTA station elevators.

So do many other people with handicaps and parents with small children who may touch or sit on the floors.

But those elevators should be a lot cleaner and more fragrant soon thanks to a new alarm system.

MARTA is the first mass transit system in the country to begin installing a urine detection system.

Activated by moisture and warmth, it sets off an alarm which nearby MARTA police officers can answer in seconds.

Right now the UDD system, as it's called, is installed in only one midtown station elevator, but will soon be in around 100 more.

"I think that's terrific because they need to do something about it," said rider Angela Trim.

"It's real good for the community and MARTA and for the riders," said Derrick Johnson.

"I think it's the greatest thing to happen since sliced bread," laughed Willie Freeman.

MARTA said someone urinated in the test elevator an average of once a day, but only once a month after the detection system was installed and that person was caught and arrested.

At $10,000 per elevator, the entire system will cost MARTA about $100,000 out of its budget.

Authorities search for endangered 4-year-old Roswell boy

ROSWELL, Ga. -- Authorities have issued a Levi's Call for a missing 4-year-old child who disappeared from an apartment on Old Holcomb Bridge Way. 

According to the Roswell Police Department, Jesus Dominguez was discovered missing from the apartment around 4:30 p.m. Authorities discovered Dominguez's mother unresponsive and transported her to a local medical center. She is listed in serious condition. 

Dominguez is described as a 3 ft. tall Hispanic male around 35 to 40 pounds. He has short black hair and brown eyes and is believed to be travelling with his father, Carlos Alberto Dominguez. 

Carlos Dominguez is described as about 33 years old, around six feet tall with short black hair, brown eyes and a thin build. 

The child is considered to be endangered. Authorities are unclear on the direction Dominguez took the child and they do not have a clear description of the car. 

Anyone with information on the child's whereabouts is being asked to contact 911 immediately or call the Roswell Police Department.

Stone Mountain woman wins Mega Millions Jackpot

(USA TODAY) -- A Stone Mountain woman was one of the two winners of Tuesday's $648 million Mega Millions jackpot.

In a press conference Wednesday afternoon, the Georgia Lottery said Ira Curry, 56, picked family birth dates and their lucky number 7.  She elected to take the cash option, which amounts to more than $173 million before taxes.

State income tax of 6 percent and federal income tax of 25 percent are automatically withheld at the time a prize is claimed, but there are ordinarily additional taxes due on prizes.

Georgia Lottery officials said Curry would receive her proceeds in about two weeks.

Curry bought her winning ticket at the Gateway Newstand in Buckhead.

The store does not get any winning money but does get 6 percent of ticket sales.

The Georgia Lottery used to pay bonuses to stores that sold winning tickets, but that was changed during the first year of Gov. Nathan Deal's administration. When Deal signed the HOPE Scholarship revamp bill in March, 2011, bonuses to stores that sold winning tickets were eliminated, and lottery employee bonuses were cut back significantly. 

This was done because lottery proceeds had flattened, and with HOPE Scholarship demand soaring, the agency's balance was in danger of turning negative. 

The other winner was a lucky costumer who bought a winning ticket at Jennifer's Gift Shop in San Jose, according to California Lottery spokesman Alex Traverso. 

After sales were tallied, the jackpot in Tuesday's drawing was increased from an advertised $636 million to about $648 million, marking the second richest lottery prize in American history.

In addition to the jackpot prize in Georgia, two $1 million prize winning tickets were sold in Columbus and Winder, three $20,000 tickets were sold in Cave Spring, Decatur and Marietta. There were also 26 $5,000 winners, 18 $2,000 winners and more than 929,000 winners at lower prize levels in the state.

"For us, the main thing we'd like to get across is the level of excitement we saw all across California," Traverso told the Associated Press. "At one point, we were selling about 25,000 tickets per minute."

"It's been an amazing experience. It's unbelievable," he said.

The odds of winning were about 1 in 259 million.

Jennifer's Gift Shop owner Thuy Nguyen will receive a prize of about $1 million for selling the winning ticket, lottery officials told the San Jose Mercury News.

"I am so happy, I feel good," Nguyen told the Mercury News after learning his store had sold the winning ticket.

There is no retailer bonus in Georgia for selling the winning ticket. 

Tuesday's jackpot had rolled over 21 straight drawings since Oct. 4, worth a lump, sum, pre-tax payout worth $314.2 million.

The winning numbers were 8, 20, 14, 17, 39 and 7.

Ticket sales - the topic of TV, radio, social media and burgeoning office pools - surged in the hours leading up to the drawing, even though up to 75% of the possible number combinations were expected to be picked.

Elderly woman's family called her killer "hideous"

MARIETTA, Ga -- Police are putting a lot of effort into solving the murder of an 86 year old woman. Juanita Calvert, who could barely see, was shot and killed for whatever reason that will never make sense.

Calvert's three granddaughters drove from Kentucky to Marietta the day after learned their grandmother was shot to death. "It really hasn't sunk in completely yet," said Carol Brasher before she quickly broke into a sob. "It kind of has now, since I've been in there (her grandmother's house). I just hope that someone comes forward."

The 86 year old woman was found dead Tuesday morning by her husband's caretaker. Her husband, Phillip Van Zandt, was in the house but could not help police with the identity of the suspect. Van Zandt is bedridden.

"Any information, no matter whether you think it's nothing that matters or not, it might be the missing piece that the police are missing," said granddaughter Lori Waide.

Calvert and her husband have been victims of a crime before. Last May Antoine Davis, a former caretaker, was arrested for stealing money from the couple, taking advantage of Calvert's poor eyesight, according to court documents. Davis is accused of having Calvert sign checks over to him for thousands of dollars.

Marietta Police Officer David Baldwin said police are not ruling out anyone as a suspect. "That's all part of the investigation," he said about the prior incident. "We're not leaving any stone unturned and everything's being taken into account for this."

Another granddaughter, Sherry Baird, said she was stunned when she received a text from her sister that their grandmother had been murdered. "That's just hideous," she said. "To think that there are people out there that would shoot an old lady in her home."

Calvert's granddaughters said they will take her body back to Kentucky where most of her family is from. They said her husband, Phillip Van Zandt, will probably go into a nursing home.

"Cabbagetown Christmas miracle" saves Little's Food Store

ATLANTA -- "Cabbagetown is just a small town in the middle of the city," take it from Brad Cunard who owns a business there, "and that's what's special."

Within the last week, he has seen his community rise up to rescue his business, Little's Food Store.

"It feels like a Cabbagetown Christmas miracle," says Cunard with a chuckle.

It is a miracle for someone who has seen this story before, in far more tragic terms.

Ten years ago, a 70-foot oak tree crushed Cunard's moving vehicle, with his wife and two children inside. They died instantly.

At that point, Cunard says, the community helped pick him back up.

"At your lowest, to see people rally around you," he said, "it touches you in such a real way."

Years later, when Brad felt himself shrinking again, along came Little's.

Cunard and second wife Nina took over the classic Cabbagetown building and turned it into an eclectic grocery and grill. But last week, due to the unavoidable high costs of major building repairs, Cunard had to make a declaration on Facebook.

"Little's is closing at the end of December," he wrote.

Cunard says he truly believed he would have to call it quits. His community wouldn't let him.

His Cabbagetown neighbors raised enough money in seven days to enable Cunard to keep Little's going -- at least in some capacity.

He will briefly close the grill but keep the grocery open, and he plans to re-open the grill when repairs are complete.

"That support does mean everything," Cunard says, "and I love the fact that people in Atlanta are that way."

86-year-old Marietta woman dead from gunshot at home

MARIETTA, Ga. -- An 86-year-old woman was found dead in her Marietta home from a gunshot wound Tuesday morning.

Yellow tape surrounds the single-family home on Aviation Road, marking off a crime scene in what neighbors describe as a usually quiet neighborhood.

"Just opened my blinds this morning and saw all the commotion outside," said neighbor Ken Milam.

At 8:20 Tuesday morning, police were summoned to the home, where the found the woman inside.

A caretaker arriving at the home found the body of 86-year-old Juanita Calvert, and called police.

Calvert's bed-ridden husband was taken from the home on a stretcher around midday. Police said he is not a person of interest in the case, but they did confirm that Calvert died from a gunshot wound and that they are presently following leads.

"Right now, we're in the process of really working the scene and full into the investigation, and we should have more information at a later time," said Marietta Police Officer David Baldwin.

2 dead in NW Atlanta plane crash

ATLANTA, Ga. -- Atlanta Fire has confirmed 2 fatalities in the small plane crash in northwest Atlanta.

According to the Federal Aviation Association (FAA), the plane went down in a vacant gully near Rutherford Street and Forrest Place around 7:25 p.m. 

FAA officials say the aircraft was a Raytheon 390 Premier I multi-engine aircraft.

The flight departed from the Fulton County Airport and was bound for the New Orleans Lakefront Airport, at the time of the crash. 

One witness said the plane "looked like the pilot deliberately headed for the vacant gully to avoid the many houses in the closely packed neighborhood." 

Officials have not yet released the identities of the persons on board the aircraft. However, they say the plane was registered to a metro Atlanta company. 

No further information was immediately available.

Winning Mega Millions tickets sold in Atlanta and Calif.

ATLANTA -- Georgia lottery officials confirm a winning Mega Millions lottery ticket was sold in Atlanta. A winning ticket was also sold in California.

Georgia Lottery officials say a winning ticket was sold at the Gateway Newstand located at 3500 Lenox Road in Atlanta.

The winning numbers were: 8, 14, 17, 20, 39; Mega Ball: 7.

The massive $636 million jackpot was just $20 million less than the largest jackpot in American lottery history.

Officials have not yet said where in Georgia the winning ticket was sold. One ticket matching all six numbers was sold at a gift shop in San Jose, California.

Two APS educators take pleas Monday afternoon

ATLANTA -- According to the Fulton County District Attorney, two APS educators were expected to enter guilty pleas in the CRCT cheating scandal on Monday afternoon. 

Shayla Smith, a former teacher at Dobbs Elementary and Sheila Evans, a former teacher at Benteen Elementary were both scheduled to enter guilty pleas around 4:30 p.m. during plea proceedings.

Proceedings will be held at the Fulton County Superior Court before Judge Jerry Baxter.

Video: Third suspect arrested in Ayvani Perez abduction

ATLANTA -- The FBI arrested a third suspect Monday in the abduction of a Clayton County teen this past September.

14 year old Ayvani Hope Perez was abducted September 17 from a home in the Ellenwood neighborhood on Brookgate Drive.

Monday the FBI arrested 19-year old Christopher Joseph Atkins, known as "CJ".

Tony Maurice Graves and Wildrego Deandre Jackson are also charged in the abduction.

A grand jury indictment accuses the three men of taking the girl and demanding a ransom for her return.

FBI agents recovered Ayvani from her aunt's house the following day, after she was let go by her abductors.

Mattie's Call issued for missing 17-year-old

ATLANTA -- Police have issued a Mattie's Call for a teen they say may be suicidal. 

According to a release from Atlanta Police, 17-year-old Jamari Norrington was last seen leaving the Sadie Mays Health & Rehabilitation Center on Monday around 6:20 p.m.

Norrington was last seen wearing a yellow shirt, blue sweatpants and a black hood with "Ed Hardy" written all over it. Authorities say he's about six feet tall and that he weights about 200 pounds. 

Family members say Norrington has previously reported suicidal thoughts and autistic behavior. 

Anyone with information on the whereabouts of Norrington is asked to call 911 or the Atlanta Police Adult Missing

Douglasville man struck, killed by oncoming train

DOUGLAS COUNTY, Ga. -- Authorities are investigating a death-by-train in downtown Douglasville. 

According to Douglasville Police, the incident happened just before noon on Sunday afternoon.

The victim, 28-year-old Hassan Reavis, was wearing headphones while walking on a railroad track near the Campbellton Street crossing when he was hit. 

Officials say the conductor of the train blew the horn several times but the man never reacted. Reavis died on the scene.

5 yr old girl shot through window in DeKalb county

a 5 year old girl was shot through the window at a DeKalb County apartment complex

DeKalb County, GA-- A five year old girl is recovering after a bullet hit her in the shoulder as she stood in an apartment watching a gun fight outside.

It happened Sunday night at the Highland Apartments on Flat Shoals Road.

Police say the little girl was standing at a window watching two people shooting at each other  in the parking lot when one of their bullets pierced her window and hit her.

When investigators arrived they say the suspects had taken off. Officers spent several hours collecting evidence including multiple shell casings in the parking lot  and talking to neighbors.

DFCS worker arrested for cocaine, pot and oxycontin

JONESBORO, Ga. -- A woman who is a social worker with DFCS bonded out of jail Sunday after being arrested a day earlier.

 Jonesboro Police suspect Ericka Thompson was driving under the influence of cocaine and marijuana.

At the time, police say, she was transporting an adult with mental disabilities to an area group home.

The incident happened at around 4 p.m. during a routine traffic stop. The officer who pulled over Thompson said his automated license reader showed her tag as expired.   He reported smelling a strong odor of marijuana.  A subsequent search uncovered a bag of marijuana along with cocaine and oxycontin.

11Alive's Duffie Dixon spoke with Jonesboro Police Chief Franklin Allen.

According to Allen, Thompson told them she was an ex-DFCS worker. However police noted an ID badge and key that suggested otherwise.

Chief Allen said police later confirmed that the woman in fact was a current DFCS worker out of the agency's Henry County office. 

"I don't know what steps DFCS has in place for ongoing drug testing, but apparently they've got a lot of problems in house  that they need to deal with," said Allen.

Sunday afternoon DFCS Spokesperson Ashley Fielding emailed 11Alive saying in part, 

Thompson was not acting in an official capacity as an employee of [DFCS]... It is Department policy to maintain a drug-free workplace, in accordance with the Federal Drug-free Workplace Act and the Georgia Drug-free Public Work Force Act.  As it would any employee accused of illegal activity, the Department will review the accusations against Ms. Thompson and determine the appropriate response once it has had an opportunity to fully understand the facts.

Chief Allen also complained that when his department tried to reach DFCS for help dealing with Thompson's passenger, who was stranded after he arrest, no one ever called him back.

"That's the protocol. We call DFCS, but I couldn't get the Clayton County office or anyone from the state to call us back," said Allen.

Police finally found a manager at the group home to respond.

11Alive News asked Fielding about the slow response complaint.

"Representatives from the Department have been in contact with local police to address any concerns they may have and ensure there are no gaps in communication," said Fielding.

According to Allen, Thompson told them she was an ex-DFCS worker. However police noted an ID badge and key that suggested otherwise.

Chief Allen said police later confirmed that the woman in fact was a current DFCS worker out of the agency's Henry County office. 

" I don't know what steps DFCS has in place for ongoing drug testing, but apparently they've got a lot of problems in house  that they need to deal with," said Allen.

Allen also complained that when his department tried to reach DFCS for help dealing with Thompson's passenger, who was stranded after he arrest, no one ever called him back.

"That's the protocol. We call DFCS, but I couldn't get the Clayton County office or anyone from the state to call us back," said Allen.

Police finally found a manager at the group home to respond.

So far, there has been no comment from DFCS.

Colorado high school shooting suspect found dead

CENTENNIAL, Colo. (WXIA) -- Police said a student is dead from an apparent self-inflicted gunshot wound after a shooting at a Centennial, Colo., high school that left another student in critical condition.

Arapahoe County Sheriff's Department officials said the shooting suspect, Karl Halverson Pierson, a male student at Arapahoe High School, entered the school during the lunch timeframe, and was looking for a particular teacher.

Officials said that when the teacher learned that Pierson was there looking for him, and that he was armed, he left the school -- which officials said was the proper course of action.

A 15-or-16 year-old female student who confronted the suspect was shot. That student was taken to Littleton Hospital, where she was listed in critical condition.

The 15-year-old female shooting victim is in critical condition. There was some initial confusion about a possible second shooting victim, but Arapahoe County Sheriff Grayson Robinson said later in the evening that the second victim had only appeared to have been shot.

The second victim who was initially thought to have been shot was transported to Swedish Medical Center in Englewood. There it was determined she was not shot. The blood found on her was from the first victim.

A third victim suffered an anxiety attack and was transported to a local hospital for treatment.

Two other students suffered emotional attacks but were treated at the scene, according to investigators.

Law enforcement officials said they conducted a search following the shooting, and discovered Pierson dead in a classroom, from what appeared to be a self-inflicted gunshot wound.

Authorities said the suspect made no effort to conceal the weapon he was carrying as he entered the school. They said he was able to get "very deep" within the school.

Officials said two devices, described as Molotov cocktails, were found inside the school building. One device was detonated by the suspect, while the other was located and rendered safe by authorities.

Officers who arrived at the school said they had to contend with smoke from the detonation of the first device -- which officers said was a bottle-based improvised incendiary weapon.

As students were being evacuated from the school, shortly after the incident occurred, they were being patted down by police.

"The kids have been through a traumatic situation," Arapahoe County Sheriff Grayson Robinson said. "We need to ensure that anyone we evacuate isn't part of our problem. We're doing the evacuation slowly and deliberately."

Officials said Arapahoe High School would be closed on Monday.

Arapahoe High School is in Arapahoe County, northeast of Denver. According to KUSA, there are 70 classrooms on the 254,000 square-foot high school campus. The school has a student population of 2,229 and the present school was constructed in 1964.

Federal subpoenas target Gov. Deal ethics complaints

ATLANTA -- Federal investigators have issued subpoenas looking for information about ethics complaints filed against Gov. Nathan Deal.

11Alive News has confirmed that former and current ethics commission staff have gotten subpoenas -- re-opening an investigation the commission itself had closed. The subpoenas indicate that a federal grand jury is probing the possibilities of criminal charges in the case.

Ethics complaints against Nathan Deal pre-date his successful run for governor in 2010. One of them involves his use of aircraft during his campaign -- alleging that Deal overpaid for plane and helicopter usage, funneling more than $135,000 into North Georgia Aviation, a company partially controlled by his family. More than a year ago, the state ethics commission unanimously dismissed that complaint.

Another complaint said Deal had spent $17,000 of campaign money on legal fees fighting ethics complaints. The commission also dismissed that claim.

When he first ran for governor, Deal had faced a congressional ethics probe -- which alleged that a Deal-owned business, North Georgia Salvage, had received preferential treatment in a state contract because of his position as a member of Congress. The feds dropped that complaint when Deal resigned from Congress to run for governor.

The state Ethics Commission itself has been through turmoil. A Republican appointee, Patrick Millsaps, engineered salary reductions for staffers who'd been handling the complaints against Deal. Millsaps emphatically said the salary cuts were budgetary and had nothing to do with the complaints against Deal. One of those staffers, former executive secretary Stacy Kalberman, was among those receiving federal subponeas.

Critics of Gov. Deal issued statements Thursday praising the feds for at least reviewing the ethics complaints.

The governor's attorney, Randy Evans, issued a statement saying that the Ethics Commission ruled correctly when it mostly exonerated Deal during its investigations - and predicted the probe would become a tool of what he called "the politics of personal destruction" during the 2014 campaign - in which Deal is running for re-election.
